Credit Application

Terms of Trade & Credit Agreement

1. The applicant agrees that all goods remain the property of Xaro (Pty) Ltd until fully paid.

2. Payment terms are strictly 30 days from date of statement, unless agreed otherwise in writing.

3. Interest at 2% per month will be charged on all overdue accounts.

4. Xaro (Pty) Ltd reserves the right to withdraw credit facilities without notice.

5. The applicant consents to credit vetting and information exchange with credit bureaus.

6. Any legal fees incurred due to default will be recoverable on an attorney-client scale.

7. Goods correctly supplied may not be returned without prior written consent.

8. Delivery shall be deemed complete upon delivery to the client’s premises or appointed representative.

9. Any claims or disputes must be reported within 7 days of delivery.

10. Risk passes to the buyer on delivery. Title passes only once full payment is received.

11. I, the undersigned, do hereby bind myself as surety and co-principal debtor in solidum for all amounts owing to Xaro (Pty) Ltd by the above-named applicant. This suretyship shall remain in full force until written release by Xaro (Pty) Ltd.

12. I acknowledge and understand that this agreement may be subject to the provisions of the Consumer Protection Act (CPA) and/or the National Credit Act (NCA) where applicable, and confirm that I have been provided a reasonable opportunity to review, understand, and accept these Terms of Trade and Credit in full.

Acceptance of Terms of Trade & Credit:

I/we declare that the above information is true and correct. I/we confirm that I/we have read, understood, and agree to the Terms of Trade and Credit as outlined by Xaro (Pty) Ltd.

Terms & Conditions of Agreement

I understand that by clicking the checkbox below and submitting this application, I am entering into a legally binding agreement with Xaro (Pty) Ltd, Registration Number: 2023/757846/07.I further declare that I am duly authorised to act on behalf of the business named above and have the necessary legal capacity to enter into this agreement.
